Background of the Study

Sexual minorities in Nigeria, including the LGBTQ+ community, face significant challenges in accessing their human rights, primarily due to the country's legal framework and societal stigma. Kano State, located in the northern region of Nigeria, has a particularly conservative and religious population, where issues related to sexual orientation and gender identity are often seen as taboo. Despite Nigeria’s commitment to international human rights frameworks, such as the Universal Declaration of Human Rights, the legal environment in Kano State is hostile to sexual minorities, often leading to discrimination, harassment, and violence against these groups.

The legal framework for the protection of sexual minorities in Nigeria is largely defined by the Same-Sex Marriage Prohibition Act (SSMPA) of 2014, which criminalizes same-sex relationships. However, this legal stance, along with local cultural norms, creates a hostile environment for sexual minorities, making it difficult for them to access basic rights such as the right to health, freedom of expression, and protection from violence. This study seeks to assess the legal framework governing the protection of sexual minorities in Kano, Kano State, and examine the extent to which the law is enforced to protect the rights of this group.

Statement of the Problem

Sexual minorities in Kano, Kano State, face widespread discrimination and violence, exacerbated by the legal and societal environment that criminalizes their sexual orientation and gender identity. The SSMPA and local religious and cultural norms contribute to the marginalization of these groups, preventing them from fully enjoying their human rights. This study seeks to investigate the legal framework surrounding the protection of sexual minorities in Kano and assess the effectiveness of existing laws in safeguarding their rights in the face of social and legal hostility.

  3. To recommend legal reforms and policies to improve the protection of sexual minorities in Kano.

Research Hypotheses

  2. Sexual minorities in Kano face significant barriers in accessing their human rights, including discrimination and legal restrictions.

  3. Legal reforms and policy changes are necessary to improve the protection of sexual minorities in Kano.

Scope and Limitations of the Study

This study will focus on the legal framework for the protection of sexual minorities in Kano, Kano State, and will assess the challenges faced by this group in accessing their human rights. It will also evaluate potential legal reforms to improve their protection. Limitations include the sensitivity of the topic in a conservative region, which may hinder data collection, and the difficulty of gaining access to sexual minorities for interviews.
