Chapter One: Introduction

1.1 Background of the Study
Public protests are a common form of civic engagement in democratic societies, and in Nigeria, the right to protest is enshrined in the Constitution (Kashim & Sanusi, 2023). In Jalingo LGA, Taraba State, protests have been a frequent response to issues such as governance, human rights violations, and economic grievances (Umar & Ibrahim, 2024). While the Constitution protects the right to freedom of assembly, there have been numerous instances where protests have been met with government repression and restrictions (Ismaila & Aliyu, 2023). This study seeks to examine how constitutional provisions for public protests are applied in Jalingo, focusing on the regulation of protests and the challenges faced by citizens.

1.2 Statement of the Problem
Despite the constitutional guarantee of the right to protest, many public demonstrations in Jalingo LGA are subjected to government crackdowns and legal restrictions that limit citizens' ability to exercise this right (Rashid & Tukur, 2023). This study will assess the constitutional provisions for regulating public protests in Jalingo, identifying gaps in their enforcement and the impact on citizens' rights to free expression.

1.3 Objectives of the Study

  • To assess the constitutional provisions for regulating public protests in Jalingo LGA.

  • To evaluate the impact of these regulations on citizens' rights to assemble and protest.

  • To recommend measures for ensuring the effective and lawful exercise of the right to protest in Jalingo LGA.

1.4 Research Questions

  • How are constitutional provisions for public protests applied in Jalingo LGA?

  • What are the challenges in enforcing the right to protest in Jalingo LGA?

  • What legal reforms can be proposed to improve the regulation of public protests in Jalingo LGA?

1.5 Research Hypothesis

  • H₁: Constitutional provisions for public protests are often violated in Jalingo LGA due to excessive government restrictions.

  • H₂: Political pressure and security concerns are the primary reasons for the limitation of protest rights in Jalingo LGA.

  • H₃: Strengthening legal safeguards and ensuring proper implementation of constitutional provisions will improve the right to protest in Jalingo LGA.

1.6 Significance of the Study
This study will contribute to the understanding of how constitutional law regulates public protests in Nigeria, providing valuable insights for policymakers, human rights organizations, and citizens. The findings will inform efforts to safeguard the right to protest and improve democratic practices.

1.7 Scope and Limitations of the Study
The focus will be on Jalingo LGA in Taraba State, specifically analyzing the regulation of public protests. The study may face limitations related to access to protest data and the reluctance of local authorities to disclose sensitive information on protest management.

1.8 Operational Definition of Terms

  • Public Protests: Collective actions or demonstrations by citizens aimed at expressing grievances or advocating for change in society.

  • Constitutional Provisions: Legal guarantees in the Nigerian Constitution that protect citizens' rights to freedom of assembly and expression.

  • Regulation of Protests: The legal framework and government policies that control the organization and conduct of public protests.
