Background of the Study
Trade unions play a crucial role in promoting workers' rights, collective bargaining, and fair labor practices in democratic societies. Constitutional law serves as the foundation for the legal protection of trade unions, ensuring their right to organize, negotiate, and advocate for fair working conditions (Abdullahi & Yusuf, 2024). In Nigeria, the 1999 Constitution (as amended) recognizes labor rights and the role of trade unions, particularly under Section 40, which guarantees the freedom of association (Ibrahim & Musa, 2023). Additionally, the Trade Unions Act provides legal backing for union activities, protecting workers from exploitation and unfair labor practices.
However, in Kano Municipal Local Government Area, trade unions face significant challenges, including government interference, suppression of labor strikes, and weak enforcement of labor laws. There have been cases of employers intimidating union leaders, restricting workers' rights, and violating collective agreements without legal consequences (Okeke & Adamu, 2023). Furthermore, the privatization of industries and informal employment have weakened trade unions, limiting their bargaining power (Bello & Nwachukwu, 2024). This study investigates how constitutional law safeguards trade unions, examines the challenges they face, and explores ways to strengthen their legal protections in Kano Municipal LGA.
1.2 Statement of the Problem
Although Nigerian constitutional law guarantees the rights of trade unions, many workers still face harsh labor conditions, lack of union representation, and suppression of collective bargaining efforts. Employers and government agencies often undermine trade union activities, and enforcement mechanisms remain weak (Oladipo & Mohammed, 2024). In Kano Municipal LGA, these challenges have led to industrial unrest, labor exploitation, and violations of workers' rights. This study seeks to assess how constitutional law protects trade unions and why labor protections remain weak in practice.
1.3 Objectives of the Study
To evaluate how constitutional law safeguards trade unions in Kano Municipal LGA.
To identify barriers to effective union activities in the study area.
To recommend legal and policy measures for strengthening trade union protections.

1.5 Research Hypotheses
H₀: Constitutional law does not provide sufficient protection for trade unions in Kano Municipal LGA.
H₁: Government interference and weak enforcement mechanisms limit union activities.
H₂: Strengthening legal frameworks can improve trade union protection and effectiveness.
1.6 Significance of the Study
This study is essential in understanding the relationship between constitutional law and labor rights, particularly in Kano Municipal LGA. It highlights legal gaps in trade union protection and provides insights into how labor laws can be strengthened. The findings will benefit policymakers, labor organizations, and human rights activists advocating for stronger labor protections.
1.7 Scope and Limitations of the Study
This study is limited to Kano Municipal LGA, Kano State, focusing on trade unions and labor laws. Limitations may include access to union data and reluctance of government officials to provide information.
