Background of the Study
Land disputes remain one of the most persistent sources of conflict and violence in Nigeria, particularly in Lafia Local Government Area (LGA), Nasarawa State, where communal conflicts over land rights and ownership have resulted in loss of lives, displacement, and economic hardship. Constitutional law in Nigeria provides mechanisms to resolve disputes over land ownership, particularly through property rights and land tenure systems. However, communal land disputes are often complicated by traditional practices and inadequate enforcement of constitutional laws.
This study seeks to investigate the role of constitutional law in resolving communal land disputes in Lafia LGA, analyzing the legal frameworks designed to protect land rights and mitigate conflicts. By examining the relationship between constitutional principles and land disputes, the study will explore how legal reforms can contribute to the peaceful resolution of conflicts in the region.
1.2 Statement of the Problem
Despite the constitutional guarantees of land rights and property ownership, communal land disputes continue to cause violence and instability in Lafia LGA. The lack of effective dispute resolution mechanisms and the overlap of traditional customs and modern legal frameworks complicate the enforcement of constitutional provisions. This study will explore how constitutional law can be utilized to resolve communal land disputes in Lafia LGA and what barriers exist to its successful implementation.
