Background of the Study
Tenant protection laws are essential for safeguarding the rights of tenants, promoting fair rental practices, and ensuring the long-term sustainability of the rental market. In Nigeria, tenant protection laws aim to regulate the relationship between landlords and tenants, ensuring fair treatment and addressing issues such as rent control, eviction procedures, and property maintenance responsibilities (Aliyu & Kura, 2024). Kaduna State, with its growing urban population, has seen an increase in rental housing demand, particularly in urban areas like the state capital, Kaduna. As the rental market expands, the enforcement of tenant protection laws becomes crucial to ensure that tenants are not subjected to exploitation or unfair treatment by landlords.

The tenant protection laws in Kaduna State are governed by both state regulations and the federal Rent Control Act, but their implementation has often been criticized for being ineffective and poorly enforced. Issues such as arbitrary rent hikes, unfair evictions, and poor housing conditions continue to affect tenants in the state. Moreover, a lack of awareness about tenant rights among renters, and a reluctance to report violations, contribute to the persistence of these challenges. This study aims to assess the effectiveness of tenant protection laws in Kaduna State and investigate whether these laws are being enforced adequately to safeguard tenants’ rights.

Statement of the Problem
Despite the existence of tenant protection laws in Kaduna State, tenants continue to face challenges such as unfair rent hikes, illegal evictions, and substandard living conditions. The effectiveness of these laws in protecting tenant rights has been questioned due to poor enforcement and a lack of awareness. This study seeks to assess the extent to which tenant protection laws have been effective in Kaduna State and identify measures to strengthen their implementation.

Objectives of the Study

  1. To assess the effectiveness of tenant protection laws in Kaduna State.
  2. To examine the challenges tenants face in asserting their rights under the existing laws.
  3. To provide recommendations for improving tenant protection laws and their enforcement in Kaduna State.

Research Questions

  1. How effective are the tenant protection laws in safeguarding tenants’ rights in Kaduna State?
  2. What challenges do tenants face in asserting their rights under these laws in Kaduna State?
  3. What recommendations can be made to improve the implementation and enforcement of tenant protection laws in Kaduna State?

Research Hypotheses

  1. Tenant protection laws in Kaduna State have a significant positive impact on tenant rights and rental market fairness.
  2. Poor enforcement of tenant protection laws contributes to the exploitation of tenants in Kaduna State.
  3. Improving tenant awareness and strengthening enforcement mechanisms will enhance the effectiveness of tenant protection laws in Kaduna State.

Scope and Limitations of the Study
This study will focus on tenant protection laws in Kaduna State, particularly in the urban areas of Kaduna city. The study will examine issues related to rent control, eviction practices, and housing conditions. Limitations include the reliance on tenant reports, which may be biased or incomplete, and the challenge of obtaining data from landlords and regulatory bodies.

  • Rent Control: Regulations that limit the amount a landlord can charge for rent and the frequency of rent increases.
